Welcome to First Move Strategies.

These Terms of Service (“Terms”) govern your access to the First Move Strategies website, your purchase of our products, and your use of services provided by First Move Strategies, LLC (“First Move Strategies,” “First Move,” “Company,” “we,” “us,” or “our”).

First Move Strategies provides financial education, financial analysis, forecasting, and strategic decision support designed to help individuals and businesses better understand their financial circumstances and evaluate potential future outcomes.

Our primary consumer offering is the Personalized 5 Year Financial Plan, a customized financial report designed to provide greater clarity regarding a client’s current financial position, financial projections, major financial decisions, and potential next steps.

By purchasing a product or engaging our services, you acknowledge that you have read and agree to these Terms.

Please review them carefully before making a purchase.

1. COMPANY INFORMATION

First Move Strategies, LLC is a financial analysis and consulting business based in California, United States.

First Move Strategies provides financial modeling, forecasting, financial education, strategic finance consulting, and related analytical services.

The Company may provide services to individuals, entrepreneurs, startups, and other organizations.

Certain consulting engagements may be governed by separate written agreements. If a separately executed agreement conflicts with these Terms, the separate agreement will control with respect to that engagement.

2. ELIGIBILITY AND ACCEPTANCE

To purchase services from First Move Strategies, you must be at least 18 years old and legally capable of entering into a binding agreement.

By purchasing our services, you acknowledge and agree that:

1. You have reviewed the description and scope of the product or service being purchased.

2. You understand the applicable price and payment terms.

3. You understand that financial projections represent estimates rather than guaranteed outcomes.

4. You agree to provide reasonably accurate and complete financial information.

5. You retain responsibility for your financial decisions.

6. You have reviewed and accepted these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not purchase our services.

Nothing in these Terms limits consumer rights that cannot legally be waived.

3. DESCRIPTION OF SERVICES

3.1 Personalized 5 Year Financial Plan

The Personalized 5 Year Financial Plan is a customized financial analysis prepared using information provided by the client and assumptions incorporated into First Move Strategies’ financial models.

The Plan is designed to help clients understand their financial position, evaluate potential financial outcomes, and identify priorities that may improve their financial circumstances.

The standard Plan includes the following components.

Five Year Financial Projection

An analysis of how income, expenses, savings, investments, debt, and net worth could change over a five year period.

Cash Flow Analysis

An evaluation of income, spending, savings capacity, and potential opportunities to improve personal cash flow.

Savings and Investment Outlook

Illustrative projections demonstrating how savings contributions, investment balances, and hypothetical rates of return could influence future financial outcomes.

Home Buying Outlook

An analysis of potential home affordability, down payment requirements, mortgage expenses, and the potential financial implications of homeownership.

Financial Scenario Analysis

Comparisons demonstrating how different financial decisions, assumptions, or circumstances may influence projected outcomes.

Personalized First Moves

A set of practical financial priorities and suggested next steps developed from the client’s financial information and stated goals.

Polished PDF Report

A professionally formatted report containing the client’s personalized financial analysis, projections, findings, and potential next steps.

Plan Walkthrough

One scheduled session during which First Move Strategies explains the report, its assumptions, key findings, and personalized First Moves.

Certain components may be adjusted when they are not applicable to the client’s circumstances or when sufficient information is unavailable.

3.2 Scope of the Standard Purchase

Unless otherwise agreed in writing, purchasing the Personalized 5 Year Financial Plan includes one customized financial analysis, one completed PDF report, and one 30-minute walkthrough.

The purchase does not include unlimited consulting, recurring financial reviews, ongoing financial monitoring, continuous updates, investment management, tax preparation, or other services not expressly identified in the standard offering.

Additional services may be purchased separately.

3.3 No Guarantee of Specific Findings

First Move Strategies does not guarantee that a completed Plan will identify particular savings opportunities, favorable financial outcomes, or specific improvements in the client’s financial circumstances.

The purpose of the Plan is to provide financial clarity and analysis, even when the results may not align with the client’s expectations.

4. FINANCIAL EDUCATION AND PROFESSIONAL ADVICE DISCLOSURES

4.1 Nature of the Services

The Personalized 5 Year Financial Plan is designed to provide financial education, analytical projections, and decision support.

It is not intended to replace the services of appropriately licensed or registered financial, investment, legal, tax, lending, or other professional advisers.

4.2 Investment Advice and Investment Management

The standard Personalized 5 Year Financial Plan does not include securities trading, investment account management, custody of client funds, or authority to execute financial transactions.

The Plan is not intended to recommend the purchase, sale, or holding of particular securities or financial products.

Investment-related projections may use hypothetical rates of return, contribution assumptions, and estimated account balances to illustrate potential financial outcomes.

These projections do not constitute guarantees of investment performance.

Clients seeking recommendations concerning specific investments, portfolio allocations, securities transactions, or investment management should consult an appropriately licensed or registered investment professional.

Nothing in these Terms limits any regulatory obligation applicable to the Company based on the services it actually provides.

4.3 Legal and Tax Advice

The standard Personalized 5 Year Financial Plan does not include legal representation, legal opinions, tax return preparation, or individualized tax advice.

Tax estimates included in the Plan are intended for illustrative planning purposes and may not incorporate every applicable federal, state, or local tax requirement.

Clients should consult qualified legal and tax professionals when making decisions that require such expertise.

4.4 Mortgage and Lending Decisions

Home buying analyses are estimates for financial planning purposes.

They do not constitute mortgage preapprovals, loan commitments, property appraisals, or guarantees of borrowing eligibility.

Actual mortgage qualification depends on factors that may include credit history, income verification, lender requirements, interest rates, existing liabilities, and underwriting standards.

Clients should consult qualified lenders before relying on any home affordability estimate when making a binding financial commitment.

4.5 Responsibility for Financial Decisions

Clients retain full responsibility for their financial decisions and actions.

First Move Strategies does not make financial decisions on behalf of clients, control client assets, or execute financial transactions.

Clients should independently evaluate significant financial decisions and seek appropriately qualified professional advice when necessary.

5. FINANCIAL PROJECTIONS AND ASSUMPTIONS

5.1 Nature of Financial Projections

Financial projections are inherently uncertain.

All financial models rely on assumptions about future economic conditions and individual circumstances.

These assumptions may include income growth, expenses, inflation, savings contributions, investment returns, interest rates, taxes, housing prices, and major life events.

Actual results may differ materially from projected outcomes.

5.2 No Guaranteed Financial Outcomes

First Move Strategies does not guarantee that a client will achieve any specific financial outcome.

This includes achieving a particular net worth, reaching financial independence, purchasing a home, becoming debt free, increasing income, reducing expenses, or achieving a particular investment return.

Financial projections are intended to illustrate potential outcomes under specified assumptions.

5.3 Financial Scores and Indicators

The Plan may include financial scores, letter grades, projected milestone ages, home affordability calculations, or other summary indicators.

These indicators are analytical tools developed for financial education and decision support.

They are not official credit ratings, lender determinations, professional certifications, or independent guarantees of financial health.

5.4 Limitations of Financial Models

Financial models simplify complex financial circumstances.

Although First Move Strategies strives to use reasonable calculations and assumptions, no financial model can account for every variable that may affect an individual’s financial future.

Models may not capture unexpected expenses, employment changes, market volatility, regulatory changes, economic disruptions, or other unforeseen circumstances.

5.5 Changes in Circumstances

Financial projections represent an analysis based on information and assumptions available at the time the Plan is prepared.

Changes in income, expenses, investments, debt, family circumstances, economic conditions, or other material factors may affect the continued relevance of the original analysis.

Unless separately purchased, the standard Plan does not include ongoing monitoring or automatic updates.

6. CLIENT RESPONSIBILITIES

6.1 Accurate Financial Information

Clients agree to provide reasonably accurate, current, and complete information.

This may include income, employment information, expenses, assets, liabilities, investment balances, savings, financial goals, and other relevant information.

First Move Strategies may reasonably rely on information supplied by the client when preparing the Plan.

Unless expressly agreed otherwise, First Move Strategies is not responsible for independently auditing or verifying every financial figure provided.

6.2 Incomplete or Incorrect Information

If client information is incomplete, inconsistent, or unclear, First Move Strategies may request clarification before completing the analysis.

Work may be paused until sufficient information is received.

If a client provides materially inaccurate or incomplete information, the resulting projections may also be inaccurate.

First Move Strategies is not responsible for inaccuracies directly attributable to materially incorrect client-provided information, except to the extent responsibility cannot legally be excluded.

6.3 Third Party Information

Clients may submit financial information concerning another individual only when appropriately authorized.

For joint or household financial plans, clients are responsible for obtaining any necessary consent from other individuals whose information is submitted.

6.4 Sensitive Financial Information

Clients should submit financial information only through the communication or intake methods designated by First Move Strategies.

Clients should not provide online banking passwords, brokerage account passwords, complete credit card numbers, Social Security numbers, or other unnecessary authentication credentials.

The standard Personalized 5 Year Financial Plan does not require direct access to a client’s bank or investment accounts.

7. PURCHASING AND FINANCIAL INTAKE

After purchasing the Personalized 5 Year Financial Plan, clients will receive instructions explaining how to complete their financial intake.

The process generally includes:

1. Completing payment through the authorized checkout.

2. Submitting financial information and personal financial goals.

3. Responding to reasonable requests for clarification.

4. Allowing First Move Strategies to prepare the personalized analysis.

5. Receiving the completed PDF report.

6. Scheduling and attending the included walkthrough.

7.1 Commencement of Work

Substantive work begins when First Move Strategies starts preparing the client’s personalized financial analysis.

This generally occurs after payment has been received and sufficient financial information has been submitted.

Preliminary administrative activities, including receiving payment and reviewing whether intake information is complete, do not automatically constitute the commencement of substantive financial analysis.

7.2 Delays Caused by Incomplete Information

If required information is missing, First Move Strategies may postpone preparation of the Plan until sufficient information is available.

The client will be notified when additional information is necessary.

The Company will make reasonable efforts to communicate outstanding requirements.

7.3 Client Nonresponse

If a client does not respond to reasonable requests for necessary information, First Move Strategies may temporarily suspend the engagement.

Before terminating an engagement for prolonged nonresponse, the Company will make reasonable attempts to contact the client and provide an opportunity to continue.

Any cancellation or refund will be handled in accordance with Section 10 and applicable law.

8. DELIVERY OF THE FINANCIAL PLAN

8.1 Delivery Method

The completed Personalized 5 Year Financial Plan will generally be delivered electronically as a PDF report.

Delivery may occur through email or another designated electronic delivery method.

Clients are responsible for providing an accurate email address and monitoring communications regarding their purchase.

8.2 Delivery Timeframe

First Move Strategies will communicate an estimated delivery timeframe through the purchase, intake, or client communication process.

Any agreed delivery period begins after the Company receives sufficient information to begin the analysis, unless otherwise expressly stated.

The Company will make commercially reasonable efforts to meet the communicated delivery timeframe.

Completion may be affected by incomplete information, necessary clarifications, unusual financial complexity, technical interruptions, or circumstances outside the Company’s reasonable control.

If a material delay occurs, First Move Strategies will communicate the issue and the anticipated next steps.

Nothing in this section eliminates a client’s rights when the Company fails to satisfy an expressly agreed delivery commitment or when cancellation or refund rights arise under applicable law.

8.3 Delivery Completion

The written report component of the engagement is considered delivered when the completed report is successfully sent to the client’s designated email address or made available through the agreed delivery method.

The included walkthrough remains a separate service obligation until completed, properly declined, or otherwise concluded under these Terms.

9. PLAN WALKTHROUGH

9.1 Included Walkthrough

The purchase of a Personalized 5 Year Financial Plan includes one 30-minute walkthrough.

The walkthrough is intended to explain the report’s findings, assumptions, financial projections, and personalized First Moves.

It also provides an opportunity for the client to ask reasonable questions concerning the completed analysis.

9.2 Scheduling Period

Clients must request or schedule their walkthrough within 30 calendar days after receiving their completed report.

An appointment may occur after the 30-day period if necessary to accommodate scheduling availability.

First Move Strategies will provide reasonable scheduling options.

If the Company cannot offer reasonable availability during the scheduling period, the client’s opportunity to receive the walkthrough will be extended accordingly.

9.3 Rescheduling

Clients may reschedule their walkthrough by providing at least 24 hours’ notice before the scheduled appointment.

One reasonable rescheduling request with appropriate notice will be accommodated without an additional charge.

Further rescheduling requests may be accommodated at the Company’s discretion.

The Company will make reasonable exceptions for emergencies and circumstances outside the client’s control.

9.4 Missed Appointments

If a client misses a scheduled walkthrough without providing reasonable notice, First Move Strategies may offer one replacement appointment, subject to availability.

Repeated missed appointments or unreasonable scheduling delays may result in the walkthrough being considered forfeited after reasonable notice, to the extent permitted by applicable law.

9.5 Expiration of Walkthrough Eligibility

If a client does not request or schedule a walkthrough within 30 calendar days following report delivery, despite receiving the necessary scheduling instructions and reasonable opportunity to schedule, the included walkthrough may expire.

First Move Strategies may extend this period at its discretion.

Nothing in this provision limits remedies available if the Company has failed to make the included service reasonably available.

9.6 Additional Consultations

Additional meetings, recurring financial reviews, expanded scenario analysis, or ongoing financial consulting are not included in the standard $299 purchase.

Such services may be offered separately at an additional agreed price.

10. REFUNDS AND CANCELLATIONS

First Move Strategies recognizes that the Personalized 5 Year Financial Plan is a customized service requiring time and analysis.

The following refund policy establishes expectations for cancellations and refunds.

10.1 Cancellation Before Work Begins

Clients who cancel before substantive work has begun are eligible for a full refund.

A cancellation request must be received before First Move Strategies begins substantive preparation of the client’s personalized financial analysis.

Administrative intake processing alone does not eliminate eligibility for a full refund.

10.2 Cancellation After Work Begins

If a client requests cancellation after substantive work has begun but before the completed report has been delivered, First Move Strategies may retain a reasonable amount reflecting work already performed.

The amount retained will be determined based on the documented work completed and the portion of the agreed service performed.

Any remaining balance will be refunded.

The amount retained will not exceed the original purchase price.

No arbitrary cancellation penalty will be imposed.

Any legally required refund rights will take precedence over this provision.

10.3 Cancellation After Report Delivery

Once the completed personalized financial report has been delivered, the purchase is generally nonrefundable solely because the client changes their mind, disagrees with the financial outlook, or decides not to use the report.

This does not eliminate the client’s rights if First Move Strategies materially fails to provide the agreed services, does not deliver required components, or otherwise becomes obligated to provide a remedy under applicable law.

10.4 Calculation Errors or Missing Deliverables

If a client identifies a material calculation error, transcription error, or missing deliverable, First Move Strategies will review the concern.

Where the issue is attributable to the Company, First Move Strategies will make reasonable efforts to correct the error or provide the missing deliverable at no additional cost.

Corrections do not include unlimited changes to assumptions or new financial scenarios requested after completion.

This provision does not replace any other remedy required by applicable law.

10.5 Cancellation by First Move Strategies

First Move Strategies reserves the right to decline or discontinue an engagement if it cannot reasonably perform the requested services, if necessary information cannot be obtained, or if completing the engagement would be inconsistent with applicable law or the Company’s service limitations.

If the Company cancels an engagement before substantive work begins, the client will receive a full refund.

If the Company cancels after work begins, the client will receive a refund for services not performed, with any additional remedies determined in accordance with applicable law.

10.6 Refund Requests

Refund and cancellation requests may be submitted to:

Clients should include their name, purchase date, and a brief explanation of the request.

First Move Strategies will review requests in a reasonable timeframe.

Approved refunds will generally be returned to the original payment method.

The timing of the funds appearing in the client’s account may depend on the payment processor and financial institution.

10.7 Consumer Rights

Nothing in this refund policy limits rights or remedies that cannot legally be waived.

11. CORRECTIONS, REVISIONS, AND ADDITIONAL SERVICES

First Move Strategies strives to provide accurate and understandable analyses.

Material errors attributable to the Company will be reviewed and corrected as appropriate.

However, the standard purchase does not include unlimited revisions.

Changes requested because of new financial circumstances, updated information, or different planning assumptions may require an additional engagement.

Examples include changes in employment, income, major expenses, investment balances, housing goals, or household circumstances occurring after the original Plan was prepared.

Additional financial analysis may be offered at a separately agreed price.

No additional fee will be charged without the client’s authorization.

12. PRICING AND PAYMENT TERMS

12.1 Standard Purchase Price

The standard price of the Personalized 5 Year Financial Plan is $299.00 USD.

This is a one-time purchase.

12.2 No Automatic Subscription

Purchasing the Personalized 5 Year Financial Plan does not automatically enroll the client in a recurring subscription.

First Move Strategies may offer optional recurring services in the future.

Such services will require separate disclosure of their pricing and terms, along with appropriate client authorization.

12.3 Payment Processing

Payments are processed through Stripe or another authorized payment processor.

By providing payment information through the checkout process, the client authorizes the payment processor to charge the amount displayed.

Payment information is subject to the processor’s applicable terms and privacy practices.

12.4 Taxes and Additional Charges

Applicable taxes and mandatory charges, if any, will be disclosed as required by law.

The amount authorized during checkout will determine the amount charged.

12.5 Future Price Changes

First Move Strategies reserves the right to modify prices for future purchases.

Changes will not retroactively increase the price of a previously completed purchase.

12.6 Payment Disputes

Clients are encouraged to contact First Move Strategies promptly regarding billing concerns.

Nothing in these Terms limits lawful payment disputes, chargeback rights, or other protections provided by applicable law.

13. INTELLECTUAL PROPERTY

13.1 Ownership of Company Materials

All preexisting and independently developed intellectual property belonging to First Move Strategies remains the property of First Move Strategies, LLC.

This includes financial models, Excel templates, proprietary formulas, calculation methodologies, financial projection systems, report designs, analytical frameworks, website content, logos, trademarks, and related business materials.

13.2 Ownership of Client Information

Clients retain ownership of the original financial information and materials they provide.

Submitting information does not transfer ownership of that information to First Move Strategies.

Clients authorize the Company to use the submitted information as reasonably necessary to perform the purchased services and for other purposes described in the Privacy Policy.

13.3 Use of Personalized Reports

Upon full payment, clients receive a nonexclusive, nontransferable license to use their completed personalized financial reports for personal financial planning and related household purposes.

Clients may retain copies of their reports and share them with appropriate third parties for legitimate personal purposes.

This may include spouses, household members, accountants, attorneys, lenders, and other professional advisers.

13.4 Commercial Restrictions

Clients may not, without prior written authorization, commercially resell First Move Strategies reports, reproduce proprietary templates for commercial distribution, represent the Company’s models or methodologies as their own products, or commercially exploit the Company’s intellectual property through unauthorized copying.

These restrictions do not prohibit lawful uses or disclosures that cannot legally be restricted.

13.5 Underlying Excel Financial Model

Purchasing the Personalized 5 Year Financial Plan does not transfer ownership of First Move Strategies’ underlying Excel financial model.

Unless expressly agreed in writing, the client purchases the completed personalized report and associated services, not the underlying model, formulas, source files, or proprietary calculation systems.

First Move Strategies retains the right to use, modify, license, and commercialize its financial modeling systems for other clients and business purposes.

14. CONFIDENTIALITY AND PRIVACY

First Move Strategies recognizes that client financial information may be sensitive and confidential.

14.1 Confidential Treatment

The Company will treat nonpublic client financial information as confidential and use it for legitimate purposes connected to service delivery, customer support, business administration, legal compliance, and other purposes described in its Privacy Policy.

14.2 Third Party Providers

First Move Strategies may use third-party providers for payment processing, website hosting, financial intake, document storage, communications, scheduling, and related business operations.

Client information may be shared with these providers to the extent reasonably necessary to perform authorized services and as described in the Privacy Policy.

14.3 Information Security

First Move Strategies will maintain reasonable administrative, technical, and organizational safeguards appropriate to the information it handles.

However, no electronic communication or storage system can be guaranteed completely secure.

Clients should use designated intake and communication channels and avoid sending unnecessary sensitive identifiers or authentication credentials.

14.4 Use of Client Information for Marketing

First Move Strategies will not publicly identify clients or disclose identifiable personal financial information in marketing materials without appropriate authorization.

The collection, use, retention, sharing, and protection of personal information are further addressed in the Company’s Privacy Policy.

Clients should review the Privacy Policy before submitting personal financial information.

Nothing in these Terms waives rights provided under applicable privacy laws.

15. NO GUARANTEE OF RESULTS

First Move Strategies provides financial analysis with the intention of helping clients make more informed decisions.

However, the Company does not guarantee any particular financial outcome.

Clients acknowledge that future financial results depend on circumstances beyond the Company’s control.

These circumstances may include employment, income, expenses, investment performance, interest rates, housing markets, economic conditions, personal decisions, and unforeseen events.

The Company’s projections, recommendations, and financial analyses are intended to inform decision-making rather than guarantee results.

16. DISCLAIMER OF WARRANTIES

First Move Strategies intends to perform the purchased services with reasonable care and diligence consistent with the agreed scope.

However, to the maximum extent permitted by applicable law, the Company does not warrant that its financial projections will precisely predict actual financial results or that implementing a particular financial priority will produce a specific benefit.

The Company does not guarantee uninterrupted website availability or error-free operation of third-party systems.

Nothing in these Terms excludes warranties, obligations, or consumer protections that cannot legally be excluded.

17. LIMITATION OF LIABILITY

17.1 Financial Decisions

Clients acknowledge that significant financial decisions involve risks and uncertainty.

First Move Strategies does not guarantee the results of decisions made by clients after reviewing their personalized financial analysis.

17.2 Exclusion of Certain Damages

To the maximum extent permitted by applicable law, First Move Strategies will not be liable for indirect, incidental, consequential, special, or exemplary damages arising from the use of its services where such limitations are legally enforceable.

17.3 Limitation Based on Fees Paid

To the maximum extent permitted by applicable law, the Company’s aggregate contractual liability arising from a particular purchased service will not exceed the amount paid by the client for that service.

For a standard Personalized 5 Year Financial Plan purchased for $299, this amount is generally $299.

17.4 Exceptions and Legal Rights

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, violations of law, or any other conduct or obligation for which applicable law prohibits a limitation or exclusion.

This section does not waive rights or remedies arising under applicable securities laws, consumer protection laws, privacy laws, or other nonwaivable legal requirements.

Any limitation of liability applies only to the extent legally enforceable.

17.5 Independent Professional Consultation

Clients are encouraged to seek qualified professional advice before making significant financial decisions, including consequential investment decisions, major borrowing commitments, and real estate transactions.

18. ACCEPTABLE USE

Clients agree not to use First Move Strategies’ website, products, or services for unlawful, fraudulent, abusive, or unauthorized purposes.

Prohibited conduct includes intentionally submitting fraudulent information, impersonating another individual, attempting unauthorized access to Company systems, and unlawfully distributing proprietary materials.

First Move Strategies may suspend or discontinue services in response to material violations, subject to applicable contractual and legal obligations.

19. THIRD PARTY SERVICES AND INFORMATION

First Move Strategies may use publicly available information and third-party data to support financial analysis.

Examples include economic assumptions, interest rates, publicly available tax information, and other financial reference data.

Although reasonable efforts may be made to use relevant information, third-party data may be incomplete, inaccurate, outdated, or revised.

First Move Strategies does not control third-party websites, payment processors, or technology platforms.

Use of third-party services may be subject to those providers’ separate terms and privacy policies.

20. WEBSITE AND SERVICE AVAILABILITY

First Move Strategies may modify, maintain, or update its website and operational systems.

Temporary disruptions may occur because of maintenance, hosting interruptions, internet outages, payment processor issues, or other technical circumstances.

The Company will make reasonable efforts to address disruptions and communicate material delays affecting active client engagements.

Where an interruption prevents completion of a purchased service, applicable cancellation and refund rights will remain available.

21. CHANGES TO SERVICES AND TERMS

First Move Strategies may update its website, services, pricing, or Terms of Service.

Updated Terms will identify their effective date.

Unless otherwise agreed or legally required, material changes will apply prospectively.

For an existing purchase, the Terms accepted at the time of purchase will generally govern that engagement.

The Company will not use updates to retroactively eliminate accrued client rights or materially reduce previously agreed deliverables without appropriate legal authority or consent.

22. DISPUTE RESOLUTION

22.1 Informal Resolution

First Move Strategies encourages clients to contact the Company directly regarding service concerns, billing disputes, or other disagreements.

The Company will make reasonable efforts to investigate concerns and seek an informal resolution.

Before initiating formal proceedings, the parties are encouraged to attempt resolution through good faith communication for approximately 30 days.

This provision does not prevent either party from seeking urgent legal relief or exercising rights that cannot legally be delayed.

22.2 Governing Law

These Terms are governed by the laws of the State of California, except where mandatory laws of another jurisdiction apply.

22.3 Legal Proceedings

If a dispute cannot be resolved informally, either party may pursue available remedies before a court of competent jurisdiction.

Nothing in these Terms prevents a party from pursuing an eligible claim in small claims court.

Applicable venue requirements and mandatory consumer protections will govern where proceedings may be brought.

22.4 Preservation of Legal Rights

Nothing in this section restricts rights or remedies that applicable law prohibits the parties from waiving.

23. EVENTS BEYOND REASONABLE CONTROL

Neither party will be responsible for delays caused by events beyond its reasonable control, except where applicable law provides otherwise.

Such events may include natural disasters, major technology outages, government restrictions, severe emergencies, or other extraordinary disruptions.

The affected party should communicate material delays when reasonably possible.

If an extended disruption prevents completion of a purchased service, the parties will address cancellation and appropriate refunds in accordance with applicable law and the portion of services already performed.

24. ENTIRE AGREEMENT

These Terms, together with the applicable service description, purchase disclosures, and any separately executed engagement agreement, establish the contractual framework governing the purchased services.

The Privacy Policy separately describes applicable personal information practices.

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Failure to enforce a provision on one occasion does not necessarily waive the right to enforce it later.

Nothing in these Terms creates or eliminates a fiduciary, professional, or other legal duty where such a duty arises independently under applicable law.

25. ELECTRONIC COMMUNICATIONS

By purchasing services through the Company’s website, clients consent to receiving electronic communications reasonably necessary to fulfill the purchased services.

These may include purchase confirmations, payment receipts, financial intake instructions, requests for information, report delivery notifications, scheduling communications, and important service updates.

Transactional communications are separate from promotional marketing communications.

Clients are not required to consent to unrelated promotional emails as a condition of purchasing the standard Plan.

27. CLIENT ACKNOWLEDGMENT

By purchasing the Personalized 5 Year Financial Plan, the client acknowledges and agrees that:

1. The Plan is a customized financial analysis based on client information and financial assumptions.

2. Financial projections do not guarantee future financial results.

3. The standard service does not include investment management, securities transactions, legal representation, or individualized tax preparation.

4. The client retains responsibility for personal financial decisions.

5. The standard purchase includes one personalized financial report and one 30-minute walkthrough.

6. Refund eligibility depends on the circumstances and whether substantive work has begun, subject to applicable law.

7. The purchase does not transfer ownership of First Move Strategies’ underlying financial models or proprietary materials.

8. The client has had an opportunity to review these Terms and the Privacy Policy before purchasing.
